Drawing from conflicts observed in online communities, I extend Pietraszewski's theory to accommodate phenomena dependent on the intersubjectivity of groups, where representations of group membership diverge. Doing so requires enriching representations to include other agents and their beliefs in a process of recursive mentalizing.

Over 90% of the organs transplanted in China before 2010 were procured from prisoners. Although Chinese officials announced in December 2014 that the country would completely cease using organs harvested from prisoners, no regulatory adjustments or changes in China’s organ donation laws followed. As a result, the use of prisoner organs remains legal in China if consent is obtained. We have collected and analysed available evidence on human rights violations in the organ procurement practice in China. We demonstrate that the (...) practice not only violates international ethics standards, it is also associated with a large scale neglect of fundamental human rights. This includes organ procurement without consent from prisoners or their families as well as procurement of organs from incompletely executed, still-living prisoners. The human rights critique of these practices will also address the specific situatedness of prisoners, often conditioned and traumatized by a cascade of human rights abuses in judicial structures. To end the unethical practice and the abuse associated with it, we suggest to inextricably bind the use of human organs procured in the Chinese transplant system to enacting Chinese legislation prohibiting the use of organs from executed prisoners and making explicit rules for law enforcement. Other than that, the international community must cease to abet the continuation of the present system by demanding an authoritative ban on the use of organs from executed Chinese prisoners. In an influential series of papers, Cleland (2001, 2002, 2011) argued that historical natural scientists employ a distinctive methodology—which exploits Lewis (1979)s asymmetry of over determination—that is capable of putting knowledge of the deep past on an epistemic par with experimental knowledge. Currie (2018) clarified the nature of the asymmetry claim and used it to argue for a more restricted form of optimism toward the historical sciences. This optimism is licensed by the evidential redundancy that the asymmetry of over determination (...) guarantees.In this chapter I show that the argument for the asymmetry of over determination is circular and the thesis is false. Over determination toward the past is smuggled in from the start by ruling out of consideration so-called backtracking counterfactuals. By banning backtracking counterfactuals, consideration is restricted to possible worlds in which the over determination thesis holds. But in the actual world, the present is compatible with many different histories. (shrink)

Sport builds character. If this is true, why is there a consistent stream of news detailing the bad behavior of athletes? We are bombarded with accounts of elite athletes using banned performance-enhancing substances, putting individual glory ahead of the excellence of the team, engaging in disrespectful and even violent behavior towards opponents, and seeking victory above all else. We are also given a steady diet of more salacious stories that include various embarrassing, immoral, and illegal behaviors in the private lives (...) of elite athletes. Elite sport is not alone in this; youth sport has its own set of moral problems. Parents assault officials, undermine coaches, encourage a win-at-all costs mentality, and in many cases ruin sport for their children. (shrink)

Some experiments are risky in that they cannot repeatedly produce certain phenomenon at will for study because the scientific knowledge of the process generating the uncertain phenomenon is poorly understood or may directly contradict with existing scientific knowledge. These experiments may have great impact not just to the scientific community but to mankind in general. Banning them from study may incur societies a great opportunity cost but accepting them runs the risk that scientists are doing junk science. How to (...) make an informed decision to accept/reject such study scientifically for the mainstream scientific community is of great importance to mankind. Here, we propose a statistical methodology to handle the situation. Specifically, we consider the likelihood of not observing the phenomenon after n trails so that it is statistically significant to have nil result. Consequently, we reject the hypothesis that there is some probability that we observe the phenomenon. (shrink)

As of March 2012, students with concealed carry permits attending public colleges and universities in the state of Colorado may carry their weapons on campus. Colorado is one of six states with legal provisions permitting guns on public campuses. An additional twenty-two states leave it up to the governing bodies of individual colleges and universities to determine their institution's gun policy, while twenty-two states ban concealed weapons on campuses. The NRA often asserts that "an armed society is a polite society." (...) They and those who favorably quote them take this as a positive result of an armed citizenry. People won't be rude. They won't argue. They won't say anything offensive, for fear of being shot. And that may be right. But we do not want a polite campus. If an armed campus is a polite campus, then students at such campuses will miss a fundamentally important aspect of their college experience. Students ought to be able to voice their opinions, to argue with others, and to test new ideas without fear. The threat of violence that guns create challenges the most fundamental liberty we have: the freedom of speech. (shrink)

Readers of Phaedrus will have noticed that the rhythm of III. Ep. 34, Palam muttire plebeio piaculum est is unique. Nowhere else does he admit a molossus-word before the final metron of the iambic senarius, and he only admits it here because he is quoting a line from the Telephus of Ennius. Since a scholar whose opinion deserves respect proposes to introduce this rhythm into a reconstruction of a fragment of Laberius it seems worth while to examine its history in (...) order to see how and why it was used, before it was finally banned. For Seneca, like Phaedrus, banns it entirely. The question has already been considered by Klotz, Grundzüge Altrömischer Metrik, pp. 324 sqq.; W. M. Background. South Africa (SA) currently has a golden opportunity to legislate on human heritable genome editing (HHGE), as the country is revising its assisted reproductive technology regulations. A set of sub-regulations that deals with HHGE, which could seamlessly slot into the current regulations, has already been developed. The principles underlying the proposed set of sub-regulations are as follows: HHGE should be regulated to improve the lives of the people and should not be banned; the well-established standard of safety and efficacy (...) should be used in the regulation of HHGE; quality of life is what matters, and not preserving a ‘normal’ genome; parents’ reproductive autonomy must be respected; and equality of access to approved HHGE technology should be promoted. Objectives. To ascertain whether the proposed set of sub-regulations that deals with HHGE is aligned with public opinion in SA, and SA’s Bill of Rights. Methods. Public opinion in SA is determined with reference to a deliberative public engagement study on HHGE conducted among South Africans, and the relevant rights in the Bill of Rights are interpreted with reference to recent case law. Results. This proposed set of sub-regulations that deals with HHGE is aligned with public opinion in SA, and SA’s Bill of Rights. Conclusion. Despite the legal and ethical complexities of HHGE, the proposed set of sub-regulations provides a targeted and effective legislative approach. They fit seamlessly into the country’s existing health law framework, creating specific legal standards for HHGE that align with both public opinion and the country’s Bill of Rights. (shrink)

The Olympic Games and the soccer World Cup are large international mega-events that demonstrate how highly valued sport is around the world. However, alongside the celebrations of sporting excellences is the opportunity to reflect upon and criticize the International Olympic Committee, the Fédération Internationale de Football Association, and the host cities for ethical concerns that often accompany these events. One recent example is FIFA’s decision to ban women’s soccer players from wearing hijabs. Yet the IOC has encoded in its own (...) charter ethical and axiological mandates that it terms Olympism. This Olympic philosophy can be fruitfully understood as an intersubjective moral approach to sport and sport governance. So conceived, it can be used to gain clarity on FIFA’s decision, both in terms of its ethical decision-making process and its conclusions. While FIFA recently lifted the ban, concerns about the process are still evident. (shrink)

Blackburn argues against naturalistic moral realism. He argues that there is no conceptual entailment from satisfying a naturalistic predicate to satisfying a moral predicate. But the moral is conceptually supervenient on the natural. However, this conjunction of conceptual supervenience with lack of conceptual entailment is something the non-realist can explain, but the realist cannot. I argue first that Blackburn’s best formulation of his challenge is his first one. Subsequently he reformulates it as a demand for a ‘ban on mixed worlds’. (...) Critics have directed their arguments against this formulation but they are ineffective against Blackburn’s first formulation. My second thesis is, even so formulated the realist can meet the challenge. The bare conceptual supervenience of the moral on the natural can be given a realist explanation by understanding names of moral properties as descriptive names of natural properties. (shrink)

We examine how opinion on a controversial real-world issue shifts as a function of reading relevant arguments and engaging in a specific mental simulation about a future, fictional state of affairs involving the target issue. Individuals thought either counterfactually about a future event (“if only X had not happened …”) or semifactually about it (“even if X had not happened …”). In Experiment 1, as expected, individuals became more in favour of a course of action (the electronic tagging of children) (...) after reading relevant supporting arguments. They also became more in favour after they thought counterfactually how a negative future event could have been avoided if only electronic tagging had not been banned some years earlier. The effects of argument relevance and type of mental simulation were additive. Using a similar procedure but a different target issue (whether the UK should join the Economic Monetary Union), Experiment 2 confirmed that the type of mental simulation exerts a substantial effect on the impact of relevant arguments. Much weaker effects arose when the mental simulation was not relevant to the target issue. We set and discuss our results in terms of dual-processing theory. (shrink)

Lethal Autonomous Weapon Systems are here. Technological development will see them become widespread in the near future. This is in a matter of years rather than decades. When the UN Convention on Certain Conventional Weapons meets on 10-14th November 2014, well-considered guidance for a decision on the general policy direction for LAWS is clearly needed. While there is widespread opposition to LAWS—or ‘killer robots’, as they are popularly called—and a growing campaign advocates banning them outright, we argue the opposite. (...) LAWS may very well reduce suffering and death in war. Rather than banning them, they should be regulated, to ensure both compliance with international humanitarian law, and that this positive outcome occurs. In 1990, the Federal Trade Commission (FTC) issued a consent order to the American Institute of Certified Public Accountants (AICPA). The order decreed the AICPA to lessen its longstanding ethics code which had until then banned the receipts of commissions, referral fees and contingent fees. The FTC alleged that the AICPA banned receipt of the fees as an attempt to restrain trade (FTC, 1990).In the present study, we sought to determine if CPAs'' preference for bans on commissions, referral fees and (...) contingent fees is related to their moral reasoning whereby CPAs perceive the bans to serve as a means of resolving ethical issues. While determining this matter cannot prove whether the bans did or did not actually result in restrained trade, it can offer insight into the perceived ethical importance to CPAs of the overturned rules. Based on a random sample of AICPA members and using Rest''s Defining Issues Test (DIT) to measure moral reasoning, we did not find a CPA''s moral reasoning to be related to his/her preference for ethics rules which ban commissions, referral fees or contingent fees. However, our results did indicate that most CPAs prefer banning commissions, referral fees and contingent fees, with those CPAs holding a higher financial stake in public accounting, namely partners, favoring banning referral fees and contingent fees significantly less than CPAs with a lesser stake. Further, we noted a significant negative relationship between financial stake and moral reasoning. These results seem to suggest that self-interest among CPAs may influence their moral reasoning.Further study is needed to examine the relationship between self-interest of CPAs and their moral reasoning. If self-interest clouds moral judgments made by CPAs, capital markets are in danger. Rendering an independent audit opinion must exclude self-interest. (shrink)

Compatibilists respond to the problem of causal exclusion for nonreductive physicalism by rejecting the exclusionist’s ban on overdetermination. By the compatibilist’s lights there are two forms of overdetermination, one that’s problematic and another that is entirely benign. Furthermore, multiple causation by “tightly related” causes requires only the benign form of overdetermination. Call this the tight relation strategy for avoiding problematic forms of overdetermination. To justify the tight relation strategy, modal compatibilists appeal to a widely accepted counterfactual test. The argument of (...) this paper is that the counterfactual test fails to legitimize the tight relation strategy as it fails to adequately distinguish between problematic and benign overdetermination. Contrary to modal compatibilists, modal dependence does not suffice for benignity. I conclude by arguing that adequately addressing overdetermination worries requires a much heavier metaphysical burden than modal compatibilists have typically recognized. (shrink)

The surge in threats aided by or carried out through cyberspace has placed significant pressure on the intelligence community to adapt or leave itself open to attack. Indeed, many in both political and intelligence circles argue for access to ever greater amounts of cyber information in order to catch potential threats before they become real. By collecting all our digital information, the intelligence community argues that it is not only able to detail what people have done or are currently doing (...) but also predict what their next move might be. However, the ethical implications are unclear and the backlash following Edward Snowden’s revelations have shown that such activities are not without controversy. This leaves the debate stuck between the important, ethical role that intelligence can play and the potential for its unrestrained use to cause undue harm. This paper will resolve this by giving greater detail to cyber-intelligence practices, highlighting the different levels of harm that the various intelligence operations can cause. The essence of this paper is not that cyber-intelligence should be banned outright, but that it can be justified given the necessary circumstances. Therefore, the paper will develop a specialised set of Just Cyber-Intelligence Principles, built on the just war tradition, to outline if and when such activities are justified. (shrink)

The Walmart Company is one of the favorite punching bags of market critics. They accuse this firm of underpaying employees, dealing unfairly with customers, exploiting suppliers, and bankrupting small competitors. Various political jurisdictions have banned this firm from their environs, either implicitly or explicitly. The present article offers a more nuanced position on the behemoth from Arkansas. Although it has some flaws, there is an overwhelming case to be made in its behalf as an employer, competitor, purchaser, benefactor of customers.

This article presents a summary of The Ordinance Concerning Higher Education in the Society of Jesus. It was issued by the general of the Society, Francesco Piccolomini, in 1651. It contains a set of guidelines for study, and is closely linked to St. Thomas Aquinas’ Summa Theologica. There is no differentiation between different types of topic: theological, philosophical, logical, metaphysical, physical—they are all present and mutually intertwined. There were two lists of issues: positive and negative. The latter contained topics which (...) were banned for study and was divided into two parts: philosophical and theological. Xenophon’s anecdote concerning the exchange of clothes between a big boy and a little boy in Cyropaedia offers a valuable framework for understanding his conception of justice and the problematics of administering it. Interpreters have erred by assuming that Cyrus’ teacher, as well as Socrates in Memorabilia, simply identifies the just with the lawful. Rather than identifying the two, both characters argue that the law is just; but they differ widely in their explanations of what makes the law just. (...) For Cyrus’ teacher, the obligation to observe the law rests on a universal pre-legal ban on violence; for Socrates statutory law is to be obeyed for utilitarian reasons. Socrates’ view thus justifies both the teacher’s insistence that Cyrus obey the law—since the law is of benefit to the community—and also Cyrus’ decision to violate the law to achieve a just and beneficial redistribution. But it offers no justification for a universal ban on violence. In conformity with the Socratic principle, Cyrus avoids violence as far as possible, but only for the prudential reasons expressed by his mother. Once he acquires the power to coerce, Cyrus uses it to enforce the principle of proportional equality and meritorious redistribution he had approved in his judgment of the actions of the big boy. This article starts from two observations. The first is that some of the most prominent debates in social and political philosophy over the last few decades have been deeply obscured by the confusion of ontological/methodological and normative questions. And the second is that the renewed interest in Hegel's social philosophy has not yet yielded anything like a widely shared view as to whether it should be banned as a totalitarian or reappraised as a liberal account. The aim of this article (...) is first to specify systematically the ontological/methodological and normative dimensions of social philosophy by giving precise definitions of core concepts and paramount positions. Secondly, it is argued that Hegel's social philosophy can be characterized as combining what is called vertical holism with liberal communitarianism. This, thirdly, sheds new light both on the nature of fundamental questions in social philosophy and on the systematic relevance of Hegel's social philosophy. (shrink)

Long a widespread and comfortable assumption in medieval studies, the notion of “courtly love” has come under considerable attack in recent years. Beginning in the 1960s, American scholars such as D. W. Robertson, Jr., E. Talbot Donaldson, and John F. Benton sharply criticized the whole concept, suggesting that it is a “myth” of rather recent origin, that it is an impediment to understanding medieval texts, and that it ought to be banned from scholarly discourse. Being rather crude and unrefined by (...) modern intellectual standards, the original theory of courtly love was very vulnerable to such criticism. By calling it into question the Robertsonians performed a useful and salutary service to scholarship, launching a much-needed reassessment which is still going on. And yet, because these revisionist scholars accepted at face value some of the most questionable assumptions underlying the theory, their critique of it often presents a view of medieval literature and society just as distorted as that which it seeks to replace. The total effect of their intervention has thus been to confuse the issue thoroughly rather than to clarify it. (shrink)

He has now pressed this suggestion further and given the results of his researches in an article called “Computing Machines and Intelligence,” together with a brief account of a “child-machine” which he has attempted to educate . In this paper we examine the study of minerals from the Renaissance to the early nineteenth century in the light of the work of Michel Foucault on the history of systems of thought. In spite of a certain number of theoretical problems, Foucault's enterprise opens up to the historian of science a vast terrain for exploration. But this is the place neither for a general exegesis nor for a general criticism of his position; our aim here is the more modest (...) one of taking certain points from Foucault's study,The order of things, and seeing how far they can be extended into an area not explicitly considered in that work.
